Refund Policy

1. Subscription Model

vexp is a Software-as-a-Service product. Upon purchase, a license key (JWT) is delivered immediately by email, granting instant access to the paid features of the vexp VS Code extension and CLI. Because the service is digital and activated on delivery, subscriptions are non-refundable except where required by applicable consumer protection law or as expressly stated below.

2. Cancellation vs Refund

These are two distinct rights and should not be confused:

The Stripe Customer Portal we provide also satisfies the upcoming EU requirement for a visible "Cancel my contract" mechanism under Directive (EU) 2023/2673, applicable from June 19, 2026.

3. EU & UK — 14-Day Right of Withdrawal

If you are a consumer (a natural person purchasing for non-business purposes) resident in the European Union or the United Kingdom, you have the right to withdraw from your subscription contract within 14 calendar days from the date of subscription, pursuant to Directive 2011/83/EU on Consumer Rights (and the UK Consumer Contracts Regulations 2013).

Because vexp delivers the license key immediately upon purchase, if you have used the service during the withdrawal period, the refund will be calculated pro-rata based on the portion of the billing period elapsed at the moment we receive your withdrawal request.

To exercise this right, email omniselect.ita@gmail.com within 14 days of your purchase, including your order email and subscription ID (the sid shown in your /account page). No reason is required.

Business purchases. The right of withdrawal does not apply to purchases made by businesses, freelancers, or any buyer providing a VAT number (partita IVA) or equivalent business identifier at checkout.

4. Australia — Consumer Guarantees

Customers in Australia are entitled to the consumer guarantees set out in the Australian Consumer Law (ACL). If the service has a major failure — for example, it is unfit for the disclosed purpose, materially differs from its description, or is unsafe — you are entitled to a refund, replacement, or repair at your choice. Minor problems will first be addressed through reasonable repair or replacement.

5. Other Jurisdictions (United States, Canada, Rest of World)

Outside the EU, UK, and Australia, no statutory refund right applies to a digital subscription service delivered on demand. This policy is published in compliance with jurisdiction-specific disclosure obligations such as California Civil Code §1723. Voluntary courtesy refunds described in §6 may still apply at our discretion.

We aim to respond within 5 business days. Approved refunds are processed via Stripe to the original payment method and typically appear on your statement within 5–10 business days, depending on your bank.

9. Chargebacks

Initiating a chargeback or payment dispute through your bank triggers immediate revocation of your vexp license, regardless of the merits of the dispute. If you believe you have a legitimate refund claim, please contact us first at omniselect.ita@gmail.com — we will respond promptly and resolve issues without the need for a chargeback.

10. Governing Law

This Refund Policy is governed by the laws of Italy and is to be read together with our Terms of Service. The statutory rights granted to consumers by their country of residence are unaffected by this policy.

11. Changes to This Policy

We may update this Refund Policy from time to time. Material changes will be communicated with at least 30 days' notice. Changes do not retroactively affect refund requests that arose under the prior version.
